International Contracts – Force Majeure (Part II)

Chambers of Commerce have published the forms that will allow companies, having international contractual relations, to request the corresponding Chamber to issue the declaration, in English, assessing the existence of causes of force majeure due to the outbreak of Covid – 19 pandemic and the restrictions imposed by Italian law for its control. The English declaration template has also been published and can be found here for your convenience.

When submitting the request, the company must declare to be unable to fulfil the contractual obligations previously assumed because of unpredictable reasons that are independent of the company’s will and ability, reasons that must be specifically indicated (e.g. the company suspended the activity following the Prime Ministerial Decree of March 22).

We bring to your attention that at the Milan Monza Brianza Lodi Chamber of Commerce, among others, the application can be filed both at the help desk and online by submitting a specific form available on the Chamber’s website. In any case, companies have to collect the declaration at the help desk.
